Gun Laws in the State of Michigan

Some of the most common crimes that Michigan defense attorneys deal with are associated with gun charges. For some people, it is often owning a gun when they do not meet the criteria and for others it may be possessing a firearm without the proper license. There are a number of Michigan laws associated with the proper way to possess and carry a firearm in Michigan and many people are simply unaware of the specifics. It’s time to inform people about the details associated with owning a gun and what you can do to protect yourself from potential legal issues. It is important to follow the proper gun guidelines because failing to do so could lead to much more trouble than many people realize.

Banned Guns

It’s important to know that the state of Michigan has a list of guns that are banned. This means that there is no way to legally obtain any of the guns listed here. Those guns and related items include:

  • Machine guns;
  • Silencers;
  • Automatic weapons;
  • Short-barreled shotguns;
  • Armor-piercing ammunition; and
  • Short-barreled rifles.

If you have any of the above items in your possession at any time, then you could be facing serious legal trouble. This is a felony charge that is punishable up to five years in prison and fine up to $2500. There are no licenses or proper documentation that allow for the sale or possession of any of the guns listed here.

Who Can Own a Gun?

There are certain individuals who may not own a firearm in the state of Michigan based on various factors. In order to qualify to own a gun you have to meet the following criteria:

  • Over the age of 18;
  • No felony convictions;
  • Clear mental health record (not declared insane, not under court order for commitment to a mental facility); and
  • Score at least a 70% on the Basic Pistol Safety Questionnaire.

Basic Criteria

In the state of Michigan, it is required to have a license for owning, carrying, possessing or transporting a firearm. If you fail to have a license, then you could be facing criminal charges.  However, if you meet the basic requirements, there is no waiting period to purchase a gun in Michigan. Additionally, at no time can you carry a firearm on or near a school property. Even if you have a license, this is not allowed. If you do so, that is considered a misdemeanor crime.
