Driving under the influence (DUI) is an issue in all 50 states, including Michigan. The state has been trying very hard to reduce DUI rates, and has been successful.

In terms of fatal accidents caused by DUIs, the national average is 30.8 percent. At 26.9 percent, the rate in Michigan is lower than the national average. In fact, between 2012 and 2013, drunk driving fatalities in Michigan decreased by more than 2 percent.

However, underage drinking is a problem in Michigan. An estimated 25.7 percent of people between the ages of 12 and 20 had drunk alcohol in the past 30 days. This is higher than the national average of 23.9 percent.

Another issue is that these young people aren’t simply having a drink or two. Many are binge drinking, which is defined as having more than four alcoholic beverages in one sitting. Approximately 16 percent of Michigan residents between the ages of 12 and 20 had admitted to binge drinking in the past 30 days.

What is Operating While Intoxicated?

Driving under the influence is the same as operating while intoxicated. Under Michigan Vehicle Code Section 257.625, this refers to a driver having a blood alcohol content (BAC) of 0.08 grams or more per 100 milliliters of blood. When testing is done by breath, the limit is 0.08 grams per 210 liters of breath. When a urine test is performed, the limit is 0.08 grams per 67 milliliters.

A DUI charge is typically a misdemeanor. However, when a person is driving under the influence and causes serious injury or death to another person, the charge is elevated to a felony. For causing serious bodily injury, the punishment is up to five years in prison and a fine of up to $5,000. For causing a person’s death, the punishment may include up to 15 years in prison and a fine of up to $10,000 but no less than $2,500.

A person could also be charged with a felony DUI for an aggravated DUI if he or she had a previous DUI conviction within the past seven years. This refers to a blood, breath or urine alcohol content of 0.17 or higher. The possible punishment is extended to up to 20 years in prison.
