Under Michigan Vehicle Code Section 257.625, this refers to a driver having a blood alcohol content (BAC) of 0.08 grams or more per 100 milliliters of blood. When testing is done by breath, the limit is 0.08 grams per 210 liters of breath. When a urine test is performed, the limit is 0.08 grams per 67 milliliters.

A DUI charge is typically a misdemeanor. However, when a person is driving under the influence and causes serious injury or death to another person, the charge is elevated to a felony. For causing serious bodily injury, the punishment is up to five years in prison and a fine of up to $5,000. For causing a person’s death, the punishment may include up to 15 years in prison and a fine of up to $10,000 but no less than $2,500.

A person could also be charged with a felony DUI for an aggravated DUI if he or she had a previous DUI conviction within the past seven years. This refers to a blood, breath or urine alcohol content of 0.17 or higher. The possible punishment is extended to up to 20 years in prison.
