UNDERSTANDING FIRST, SECOND AND THIRD-DEGREE HOME INVASION

As a minimum standard, a home invasion occurs when an individual breaks and enters a dwelling, or enters a dwelling without permission. In other words, it is possible to face home invasion charges without technically “breaking and entering.” Even if a door is unlocked and wide open, entering a home without permission is a legal violation. If a person enters the home in this manner and commits a misdemeanor offense while in the home (or while entering or exiting), that constitutes third-degree home invasion, which is a felony charge.

If, during a home invasion, the person in question commits or intends to commit burglary, assault or another felony offense, that person could be charged with second-degree home invasion.

If there is someone home during the home invasion, or if the defendant is armed with a dangerous weapon, the charge is increased to first-degree home invasion. This is a felony that is punishable by up to 20 years in prison, a fine of up to $5,000 or both.
