Home invasion charges come with serious consequences. Regardless of the specific circumstances surrounding an alleged break-in, home invasion is always a felony charge in Michigan, which means that defendants face large fines and possible prison time.
At The Law Offices of Bradley J. Friedman, we will help you challenge the charges you are facing, and minimize the impact of these charges on your life.
As a minimum standard, a home invasion occurs when an individual breaks and enters a dwelling, or enters a dwelling without permission. In other words, it is possible to face home invasion charges without technically “breaking and entering.” Even if a door is unlocked and wide open, entering a home without permission is a legal violation. If a person enters the home in this manner and commits a misdemeanor offense while in the home (or while entering or exiting), that constitutes third-degree home invasion, which is a felony charge.
If, during a home invasion, the person in question commits or intends to commit burglary, assault or another felony offense, that person could be charged with second-degree home invasion.
If there is someone home during the home invasion, or if the defendant is armed with a dangerous weapon, the charge is increased to first-degree home invasion. This is a felony that is punishable by up to 20 years in prison, a fine of up to $5,000 or both.
Home invasion charges don’t have to derail your life. To learn more about how an attorney can help you navigate the legal system, call The Law Offices of Bradley J. Friedman or reach us via email.
